A New Zealand man has been sentenced to three months in jail and one day of community service for selling and supplying Viagra.

The man, who has pleaded not guilty, has been sentenced to a three-month prison term and ordered to pay €2,000 in costs after pleading guilty to a number of offences in relation to selling and supplying the prescription drug.

The court heard Mr Preet Bhattacharya, of the Balapur area of Maung Coast, had supplied about 100,000 packs of Viagra to a customer at a house in the community in the north of the province who bought the drug from Mr Preet's farm.

When the customer arrived at the house, he had a short stay in a local restaurant and was then asked to leave.

Mr Bhattacharya, who has served in the UK and is a pharmacist for the UK and Europe, was sentenced to three months in jail and ordered to pay €2,000 in costs after pleading guilty to selling and supplying the prescription drug.

Mr Bhattacharya was found guilty on 29 August 2018.

Judge David Healy said: "It is clear that the man was using drugs in a way that could be harmful to the health of his wife and children."

Mr Bhattacharya was ordered to pay a total of €250,000 in costs and a further €25,000 was ordered to be paid to the family.

He was also ordered to pay €1,500,000 and €500,000 in criminal and sentence costs.

The court heard Mr Bhattachary's wife, Mrs Bhattachary, had been diagnosed with chronic pulmonary hypertension (COPH) in 2000 after taking Viagra for more than a year.

After having her COPH treatment done, she suffered from pulmonary hypertension which is caused by the narrowing of the blood vessels supplying her lungs.

She had to undergo several tests before her COPH was diagnosed and her condition was improved when her husband bought the drug from Mr Bhattachary's farm.

She was prescribed Sildenafil (Viagra), the generic drug for the treatment of erectile dysfunction, for a period of four months. She was also advised to have sex three times a week.

The court heard Mr Bhattachary had also received a package from a woman at his house in Balapur.

He had paid €200 to the woman for the drugs and she had paid €150 to the man for the medication.

He said the woman had contacted him in the past and was not aware of her request to buy the drugs from Mr Bhattachary.

She also said she was being treated for her pulmonary hypertension, but had not told Mr Bhattachary of any reasons why she might not get the treatment, when Mr Bhattachary bought Viagra from the woman.

Mr Bhattachary told the court that the woman had contacted him in the past, but had not told him about her request to buy the drugs.

He said she had not given her the reason for her request to buy the drugs.

He said there was no evidence she had any pre-existing medical conditions, including a heart condition, high blood pressure or liver disease.

Mr Bhattachary said he would seek advice from a doctor who could advise him on the treatment.

He said he would have to make a full determination of the patient.

He said he was satisfied with the treatment and would take the patient to a specialist.

He said he had no further evidence at the time that the woman was seeking treatment for her COPH.

He said the woman did not have any pre-existing medical conditions, including a heart condition, high blood pressure or liver disease.
